Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Medical Test Prep mobile application and related services (the "Service"), operated by Medical Test Prep, LLC ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age required by applicable law in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.

2. Educational Purpose Only

The Service is an educational study tool designed to help medical trainees and professionals prepare for certification and licensing examinations. All content is provided for informational and educational purposes only and does not constitute medical advice, diagnosis, or treatment. Do not rely on content within the Service for clinical decision-making.

3. No Guarantee of Results

Use of the Service does not guarantee exam results, certification outcomes, academic performance, or professional success. Performance data within the App reflects your engagement with our study tools only.

4. Accounts and Access

Some features may allow or require an account. If you create an account, you are responsible for maintaining its confidentiality and for all activity that occurs under it. You agree to provide accurate information when creating your account.

We may restrict, suspend, or terminate access to the Service at any time for violations of these Terms, misuse of the Service, or conduct that harms the Service or other users.

5. Free Access and Sponsored Content

5.1 Free Access Model
The Service is provided free of charge to users and is supported by sponsorships from medical device manufacturers, pharmaceutical companies, and other organizations with a legitimate educational interest in reaching medical trainees and professionals.

5.2 Sponsored and Promotional Content
The Service may include sponsored, promotional, or third-party educational content. Any such content will be clearly identified as sponsored or promotional. Sponsored content does not influence quiz questions, answer keys, performance scoring, or any other educational content in the Service.

5.3 Sponsor Compliance
Sponsorship arrangements involving healthcare professionals are subject to applicable laws and regulations, including the Physician Payments Sunshine Act. Medical Test Prep, LLC maintains editorial independence over all educational content within the Service.

6. Data, Analytics, and Commercial Partnerships

6.1 Usage Data Collection
To operate and improve the Service, we collect learning activity, usage analytics, and session-level data as described in our Privacy Policy, which is incorporated into these Terms by reference.

6.2 Aggregate Data and Commercial Use
We may generate aggregate, anonymized insights from usage data and use or license those insights for research, benchmarking, and commercial data partnership purposes.

6.3 Individual Data Protections
We will never sell or share data that identifies any individual user, share individual quiz scores or study history with third parties, provide any third party with access to raw user-level data, or use individual learning performance data to evaluate a physician's clinical competency.

7. License and Acceptable Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial educational purposes in accordance with these Terms.

You agree not to:

• Copy, reproduce, distribute, sell, sublicense, or reverse engineer any part of the Service
• Interfere with the security, integrity, or performance of the Service
• Use automated scripts, bots, crawlers, or scraping tools to extract content or data
• Circumvent, disable, or interfere with access controls or security features
• Share or resell access to the Service in a manner not expressly permitted
• Use the Service for any unlawful, misleading, or abusive purpose

8. Content Ownership and Intellectual Property

All educational content, software, trademarks, and materials provided by Medical Test Prep, LLC are owned by us or our licensors and are protected by applicable intellectual property laws. If you create content within the Service, you retain ownership of that content and grant us a limited license to host and display it solely to operate the Service.

9. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that harms the Service or other users. You may stop using the Service at any time.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Medical Test Prep, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service. Our total liability will not exceed the greater of the total amount you paid in the twelve months preceding the claim or $100.

Apple Inc. has no responsibility for the Service or its content and is not a party to these Terms.

12. Changes to These Terms

We may update these Terms from time to time. Your continued use of the Service after any update constitutes your acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.
