Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the EMIGS Prep mobile application and related services (the “Service”), operated by Medical Test Prep, LLC (“we,” “us,” or “our”).

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old (or the minimum age required by applicable law) to use the Service.

Educational Purpose Only

The Service is an educational study tool. Content is provided for informational and educational purposes only and does not constitute medical advice, diagnosis, or treatment.

No Guarantee of Results

Use of the Service does not guarantee exam results, certification outcomes, academic performance, or professional success.

Accounts and Access

Some features may allow or require an account (for example, signing in with email). If you create an account, you are responsible for maintaining its confidentiality and for all activity that occurs under it.

We may restrict, suspend, or terminate access in accordance with these Terms.

Subscriptions and Premium Features

The Service may offer free and premium features. If paid features are offered, pricing and billing terms will be presented at the time of purchase and (where applicable) handled through the app store you used to download the App.

Sponsored or Promotional Content

The Service may, from time to time, include sponsored, promotional, or third-party educational content. Any such content will be clearly identified as sponsored or promotional. Sponsored content may include educational materials, practice modules, or informational resources provided by third parties.

Sponsored content does not influence educational scoring, performance tracking, or study outcomes. Medical Test Prep, LLC does not provide medical or professional endorsements of any sponsored or third-party content.

We do not use learning or usage data to serve targeted advertising or sponsored content, and analytics data is not sold to third parties.

You are not required to interact with sponsored content in order to use the core educational features of the Service.

License and Acceptable Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial educational purposes.

• Do not copy, distribute, sell, or reverse engineer the Service.
• Do not interfere with security or functionality.
• Do not use the Service unlawfully or abusively.

Prohibited Conduct

• Use the Service for any unlawful, misleading, or abusive purpose.
• Attempt to access, scrape, reverse engineer, or interfere with the Service or its underlying systems.
• Use automated scripts, bots, or tools to extract content or data.
• Circumvent, disable, or interfere with security or access controls.
• Share, resell, or provide access to the Service in a way not expressly permitted.
• Upload content that is infringing, offensive, or violates applicable laws.

Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms, misuse the Service, or engage in conduct that harms the Service or other users.

You may stop using the Service at any time. Termination does not affect provisions that by their nature should survive, including intellectual property rights, disclaimers, and limitations of liability.

Content Ownership

All content provided by Medical Test Prep, LLC is owned by us or our licensors and protected by intellectual property laws.

If you create or upload content within the Service, you retain ownership of that content. You grant us a limited license to host, store, process, and display it only as needed to operate the Service and provide the features you use (for example, saving your flashcards or syncing your account if enabled).

Feedback

Feedback you voluntarily provide may be used by us to improve the Service, without obligation or compensation.

Privacy

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms.

Analytics and Service Improvement

To operate, maintain, and improve the Service, we may collect limited usage and performance information, such as feature interactions and session-level activity. This data is used to improve educational effectiveness, app reliability, and user experience, and is handled in accordance with our Privacy Policy.

Disclaimers

The Service is provided “as is” without warranties of any kind.

Limitation of Liability

To the maximum extent permitted by law, Medical Test Prep, LLC will not be liable for indirect or consequential damages. Our total liability will not exceed the amount paid for the Service in the preceding 12 months or $100, whichever is greater.

These Terms are between you and Medical Test Prep, LLC, not Apple Inc. Apple has no responsibility for the Service or its content.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and may provide additional notice within the App.

Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
