These Terms of Use ("Terms") govern your access to and use of the Medical Test Prep mobile application and related services (the "Service"), operated by Medical Test Prep, LLC ("we," "us," or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old (or the minimum age required by applicable law in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement.
2. Educational Purpose Only
The Service is an educational study tool designed to help medical trainees and professionals prepare for certification and licensing examinations. All content is provided for informational and educational purposes only and does not constitute medical advice, diagnosis, or treatment. Do not rely on content within the Service for clinical decision-making.
3. No Guarantee of Results
Use of the Service does not guarantee exam results, certification outcomes, academic performance, or professional success. Performance data within the App reflects your engagement with our study tools only and is not a prediction or guarantee of examination outcomes.
4. Accounts and Access
Some features may allow or require an account. If you create an account, you are responsible for maintaining its confidentiality and for all activity that occurs under it. You agree to provide accurate information when creating your account and to update it as necessary.
We may restrict, suspend, or terminate access to the Service at any time for violations of these Terms, misuse of the Service, or conduct that harms the Service or other users.
5. Free Access and Sponsored Content
5.1 Free Access Model
The Service is provided free of charge to users. The Service is supported by sponsorships from medical device manufacturers, pharmaceutical companies, and other organizations with a legitimate educational interest in reaching medical trainees and professionals.
5.2 Sponsored and Promotional Content
The Service may include sponsored, promotional, or third-party educational content. Any such content will be clearly identified as sponsored or promotional so you always know when content is supported by a third party.
Sponsored content may include educational materials, branded informational resources, practice modules, or promotional messaging from our sponsor partners. Sponsors are selected based on their relevance to surgical and medical education.
Sponsored content does not influence quiz questions, answer keys, performance scoring, or any other educational content in the Service. Medical Test Prep, LLC does not provide medical or professional endorsements of any sponsored or third-party content or the products and services they represent.
You are not required to interact with sponsored content in order to use the core educational features of the Service.
5.3 Sponsor Compliance
Sponsorship arrangements involving healthcare professionals are subject to applicable laws and regulations, including the Physician Payments Sunshine Act and applicable industry codes of conduct such as the AdvaMed Code of Ethics. Medical Test Prep, LLC maintains editorial independence over all educational content within the Service, and no sponsor has input into or control over quiz content, flashcard content, explanations, or scoring.
6. Data, Analytics, and Commercial Partnerships
6.1 Usage Data Collection
To operate and improve the Service, we collect learning activity, usage analytics, and session-level data as described in our Privacy Policy, which is incorporated into these Terms by reference.
6.2 Aggregate Data and Commercial Use
We may generate aggregate, anonymized insights from usage data across our user base and use or license those insights for research, benchmarking, and commercial data partnership purposes, including:
- Providing residency programs, medical schools, and graduate medical education offices with aggregate performance benchmarking and curriculum analytics
- Licensing aggregate, anonymized data to medical device manufacturers, pharmaceutical companies, and their research partners for market research and educational planning purposes
- Supporting academic and clinical research through data licensing agreements with research institutions and medical schools
- Providing healthcare systems, hospital networks, and physician workforce planning organizations with aggregate pipeline and specialty distribution intelligence
6.3 Individual Data Protections
Regardless of any commercial data arrangement, we commit to the following:
- We will never sell or share data that identifies, or could reasonably identify, any individual user
- We will never share individual quiz scores, performance records, or study history with any third party in a form linked to a specific person
- We will never provide any third party with access to raw, user-level data
- We will never use individual learning performance data to evaluate a physician's clinical competency or share it with licensing bodies, employers, or credentialing organizations
7. License and Acceptable Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial educational purposes in accordance with these Terms.
You agree not to:
- Copy, reproduce, distribute, sell, sublicense, or reverse engineer any part of the Service or its content
- Interfere with the security, integrity, or performance of the Service
- Use automated scripts, bots, crawlers, or scraping tools to extract content or data from the Service
- Circumvent, disable, or interfere with access controls, authentication systems, or security features
- Share, resell, or provide access to the Service in a manner not expressly permitted by these Terms
- Upload or transmit content that is infringing, offensive, unlawful, or harmful
- Use the Service for any unlawful, misleading, or abusive purpose
8. Content Ownership and Intellectual Property
8.1 Our Content
All educational content, software, trademarks, and materials provided by Medical Test Prep, LLC are owned by us or our licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership interest in our content.
8.2 Your Content
If you create or upload content within the Service, such as custom flashcards, you retain ownership of that content. You grant us a limited, non-exclusive license to host, store, process, and display your content solely as needed to operate the Service and provide the features you use. We do not claim ownership of content you create.
8.3 Feedback
Feedback you voluntarily provide to us may be used to improve the Service without any obligation or compensation to you.
9. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms, misuse the Service, or engage in conduct that harms the Service or other users. You may stop using the Service at any time.
Upon termination, provisions that by their nature should survive will continue to apply, including intellectual property rights, disclaimers, limitations of liability, and dispute resolution terms.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Educational content in the Service is reviewed for accuracy, but we make no representation or warranty that content is complete, current, or suitable for any particular clinical or examination purpose.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Medical Test Prep, LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including loss of data, loss of revenue, or failure to achieve a particular result.
Our total liability to you for any claim arising out of or related to these Terms or the Service will not exceed the greater of: (a) the total amount you paid for the Service in the twelve months preceding the claim, or (b) $100.
These Terms are between you and Medical Test Prep, LLC. Apple Inc. has no responsibility for the Service or its content and is not a party to these Terms.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and may provide additional notice within the App. Your continued use of the Service after any update constitutes your acceptance of the revised Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles. Any disputes arising out of or related to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in North Carolina.
